Petro-Canada Lubricants – “WIN FREE GAS” Contest Rules & Regulations – November 7, 2022 – December 23, 2022
NO PURCHASE NECESSARY. Purchase will not improve chances of winning.
The Prize:
Prizes awarded within the “WIN FREE GAS” Contest (“Contest”) will consist of a Petro-Canada™ gift card or combination of gift cards loaded with $2,000.00, valid at participating Petro-Canada locations (“Prize”).
There will only be three (3) Prizes available to be won within the Contest:
- Prizes will be available for entrants who enter through a participating Oil Change Facility (including participating quick lube shops, automotive specialty shops, car dealerships and independent garages) and entrants who enter through the no-purchase method of entry.
Each of the above is to be considered an “Eligible Prize Pool.”
A complete list of participating Oil Change Facilities (individually and collectively, participating “Oil Change Facilities”) is available by sending a written request to Michael.Dodig@HFSinclair.com during the Contest Period (defined below).
Prizes are not redeemable for cash, not exchangeable, not transferrable, non-refundable and cannot be substituted, except at the sole discretion of the Contest Sponsor.
Under no circumstances will the Contest Sponsor, or its directors, officers, employees, representatives, agents or mandataries, including advertising and promotion agencies, be required to award more Prizes than indicated in these Contest Rules or award the Prize other than in accordance with these Contest Rules.
Eligibility:
The Contest is open only to eligible Canadian residents outside of Quebec who have reached the age of majority in their province/territory of residence and. All employees, representatives, agents, mandataries, directors, officers and shareholders of Petro Canada Lubricants Inc. (the “Contest Sponsor”) and its affiliates, subsidiaries, independent contractors and advertising and promotion agencies as well as persons domiciled with one of the above-mentioned persons is not eligible to enter the Contest.
Methods of Entry:
To enter, an eligible entrant must, between November 7, 2022 at 12:01 a.m. Eastern Time (“ET”) and December 23, 2022 at 11:59 p.m. ET (“Contest Period”): (i) purchase a SUPREME Synthetic or DURON Oil Change from any participating Oil Change facility supplied by Petro-Canada Lubricants; and (ii) complete the online registration form located at www.pclwinfreegas.ca. All information requested in the online registration form must be completed and submitted during the Contest Period, including the receipt number for the eligible purchase. The Contest Sponsor is the official timekeeper for the Contest.
Alternatively, an eligible entrant may enter by drafting one (1) handwritten, not mechanically reproduced, original, distinctly worded, essay between 50 and 100 words long describing why the entrant likes a Full synthetic oil change and submitting such essay along with the entrant’s name, telephone number, email address and mailing address, by mail to: Petro-Canada Lubricants “WIN FREE GAS” Contest, 2310 Lakeshore Rd. West, Mississauga, Ontario, L5J 1K2. Entries must be postmarked no later than December 23, 2022 and received by the Contest Sponsor no later than the Draw Date and Time.
Entries, which do not conform to these Contest Rules, will be disqualified, as determined by the Contest Sponsor in its sole discretion. Limit of one (1) entry into the Contest per person, regardless of method of entry.
Entries made with multiple addresses, under multiple identities, through the use of any device or artifice to enter multiple times or entries that are in excess of the permitted number of entries for the Contest Period are automatically void. Any purchase transaction receipt number obtained through unauthorized sources or fraudulent means or used for the purposes for entering the Contest more than once will render the relevant entry or entries automatically void.
Draw Process:
The selected entrant will be drawn from all eligible entrants in the applicable Eligible Prize Pool, by means of a random electronic draw on January 13, 2023 at 11 a.m. ET (“Draw Date and Time”) at 2310 Lakeshore Road West, Mississauga Ontario L5J 1K2. The selected entrants will be contacted by the Contest Sponsor by email, telephone and/or mail on or by February 1, 2023. If contact cannot be made within 15 days of the Draw Date and Time, another eligible entrant will be selected from remaining eligible entries in accordance with these Contest Rules; and the initial selected entrant will be disqualified.
Each winner must claim his or her Prize: (i) on or by the date identified by the Contest Sponsor when he or she is declared a winner, and (ii) at the Participating Oil Change Facility at which the eligible purchase was made or at the Participating Oil Change Facility or other location identified by the Contest Sponsor when he or she is declared a winner. All Prize claims are subject to verification by the Contest Sponsor, participating Oil Change Facilities and/or their designated representatives, including identity and age verification. The Contest Sponsor will be the sole and final reference source in validating Prize claims.
Odds of Winning:
Odds of winning depend on the total number of eligible entries received during the Contest Period.
Conditions:
By participating, each eligible entrant and each winner agrees:
- to be bound by these Contest Rules and the decisions of the Contest Sponsor, which are final and binding in all respects,
- to the collection and use of his/her personal information by the Contest Sponsor for the purpose of administering the Contest in accordance with the Contest Sponsor’s Privacy Statement available at https://lubricants.petro-canada.com/en-CA/Privacy-Policy,
- to permit Contest Sponsor to use his/her name, address, photograph, video, or likeness for advertising or publicity purposes in any media now known or thereafter discovered, worldwide, without any additional notice, review, approval or compensation, and
- to sign a Declaration and Release Form to this effect.
Before being declared a winner, selected entrants must: (i) complete, sign and return to the Contest Sponsor the Declaration and Release Form within the timeframe indicated therein; and (ii) answer correctly, unaided and in a limited time a mathematical skill-testing question administered by phone or in the Declaration and Release Form.
The Contest Sponsor shall ensure that personal information submitted by entrants is collected, used and disclosed solely for the purpose of administering the Contest, and that it is only accessed by those employees, agents and representatives who require the information for such purpose. The Contest Sponsor shall hold such personal information at its office located at 2310 Lakeshore Rd. West, Mississauga, Ontario, where requests for access and/or rectification of such information can be mailed.
Contest Amendment, Cancellation, Termination or Suspension:
The Contest Sponsor reserve its right to amend, cancel, terminate, or suspend this Contest and/or to amend the Contest Rules, at its sole discretion: (i) in the event of a technical failure, computer virus or bug, unauthorized human intervention, fraud or any other occurrence or cause beyond its control that corrupts or adversely affects the administration, security, fairness or normal operation of the Contest, as solely determined by the Contest Sponsor, or (ii) for any other reason, at the Contest Sponsor’s sole discretion. In such event, the Contest Sponsor reserves the right, at its sole discretion, to determine the winner from entries received prior to actions taken, or as otherwise deemed fair and equitable by the Contest Sponsor.
Release, Indemnification, Limitation of Liability:
Except where prohibited by law, by entering the Contest, entrants release, discharge and agree to indemnify and hold harmless the Contest Sponsor, its affiliates, subsidiaries, independent contractors, advertising and promotion agencies, and all of their respective employees, representatives, agents, mandataries, directors, officers and shareholders (individually and collectively, the “Releasees”) from and against all liability, claims, actions or proceedings, losses, injuries, and damages (whether due to negligence or otherwise) to persons (including death) and property, or violation of intellectual property rights or personal rights (such as, but not limited to, copyright, patent, trade name/trademark, and/or privacy rights or publicity, or defamation, slander or libel, or portrayal in a false light), or breach or failure in any representation or warranty, due in whole or in part, directly or indirectly to the acceptance, possession, use or misuse of the Prize, or participation in the Contest, or participation in a Contest-related activity.
Releasees shall not be responsible for incorrect or inaccurate transcription or registration of Contest entry information, technical malfunctions, lost, delayed, incomplete, interrupted, misdirected, stolen, illegible, or deleted data, network transmission failures, line failures of any telecommunication network, failure of computer equipment, software, inability to access any online service or website, inability to submit the registration form or any other malfunction or human or technical error, or for any injury or damage to entrant's or any other person's computer related to or resulting from participation or downloading any materials connected to this Contest, or for late, lost, stolen, postage due, illegible, incomplete, non-delivered or misdirected mail-in entries.
If a selected entrant is awarded a Prize due to a system error, malfunction, defect or error, the Prize will be returned to the applicable Eligible Prize Pool, to be re-awarded.
Any attempt to deliberately damage any web site or undermine the legitimate operation of the Contest is unlawful and subject to legal action by the Contest Sponsor or its agents.
TO THE MAXIMUM EXTENT PERMITTED BY LAW RELEASEES WILL NOT BE RESPONSIBLE OR LIABLE FOR ANY DAMAGE OR LOSSES OF ANY KIND, INCLUDING INDIRECT, INCIDENTIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF THIS CONTEST, INCLUDING, WITHOUT LIMITATION, PARTICIPATION IN THE CONTEST, ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZE. WITHOUT LIMITING THE FOREGOING, EVERYTHING ON THE WEB SITE AND THE PRIZE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE. SOME JURISDICTIONS MAY NOT ALLOW LIMITATIONS OR EXCLUSIONS OF LIABILITY FOR INCIDENTIAL OR CONSEQUENTIAL DAMAGES OR EXCLUSIONS OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO ENTRANTS. CHECK LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THE FOREGOING.
Governing Law:
The Contest is subject to all federal, provincial and local laws, as well as the rules adopted in view of said laws. All issues and questions concerning the construction, validity interpretation and enforceability of the Rules or the rights and obligations as between the entrant and the Contest Sponsor in connection with the Contest shall be governed by and construed in accordance with the laws of the province of Ontario without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction's laws. Void where prohibited.
